Local 727 Wins Fight Against Osco’s Holiday Scheduling Contract Violations

Teamsters Local 727 won a grievance to ensure Osco pharmacists no longer will have their contractual rights violated when it comes to holiday scheduling.

The grievance came about when several Osco pharmacists were forced to work the Thanksgiving holiday without volunteering, per the collective bargaining agreement. The Collective Bargaining Agreement specifically states that full-time pharmacists cannot be required to work Thanksgiving unless they volunteer to do so or were hired after Oct. 16, 1996, and have less than five years of seniority.

“Holiday scheduling was an issue because the company has not abided by the contract,” said John Coli Jr., President of Local 727. “We sincerely hope this grievance settlement will finally clear up the company’s apparent confusion about our members’ contractual rights.”

According to the settlement agreement, which was executed Dec. 7:

The Employer shall immediately send notification to all bargaining unit pharmacists that “As provided in the collective bargaining agreement no regular full-time pharmacist is required to work on Thanksgiving, Christmas, or New Year’s Day, unless otherwise volunteered and except that full-time pharmacists hired after October 16, 1996 with less than five (5) years of continuous service may be required to work New Year’s Day up to eight (8) hours, not to exceed 5:00 p.m.”

Going forward, the company will offer all regular full-time pharmacists an opportunity to volunteer to work on the above holidays in writing.

Additionally, the settlement agreement states: No Pharmacist can or will be disciplined by the Company for refusing to volunteer to work the holidays listed above.
