Keurig Dr Pepper Makes the Disgusting Decision to Appeal the NLRB’s Recent Ruling
On February 12, the American Bottling Company, a Keurig Dr Pepper subsidiary, filed a petition for review in the District Court of Appeals challenging the National Labor Relations Board’s recent Summary Order.
According to the NLRB’s website, of the countless NLRB decisions issued in 2019, only two petitions for review were filed. Most companies accept their loss and honor their employees’ democratic choice. Keurig Dr Pepper, however, has made the outrageous and repugnant decision to appeal, not one, not two, but three decisions issued by the Region 13 and/or the NLRB and continues to refuse to bargain with Teamsters Local 727 over a first contract for Northlake-based Sales Service Representatives and Account Managers.
“A judge’s role is to enforce the law, not create new ones. The law has been on Local 727’s side every step of the way,” said John Coli, Jr., Secretary-Treasurer of Local 727. “Local 727 remains hopeful that the D.C. Circuit Court will follow the current law and once again order Keurig Dr Pepper to bargain with the Union.”
Keurig Dr Pepper appears to have hired attorney Corey Franklin of the Ford Harrison law firm to pursue this matter. Despite having in-house counsel, Keurig Dr Pepper has seemingly decided to pay what the Union estimates to be in the thousands of dollars to use outside counsel to fight democracy.
Local 727 believes workers have the right to know how much money Keurig Dr Pepper has chosen to unnecessarily spend on outside counsel to fight their own employees. As such, the Union sent an information request on February 12 to ascertain precisely how much the Company has spent to fight its sales employees by endlessly pursuing meritless appeals.
“If Keurig Dr Pepper thinks that appeals will halt the Union’s strength, they are sorely mistaken,” added Coli. “Local 727 is here for the salesmen and will continue to fight this corporate bully. I urge all of our Union Brothers and Sisters to continue to stand united in this fight. We cannot give up now. We must continue to show our Union power, which comes from our solidarity.”
