Union Fights Company’s Wrongful Denial of Member’s Light-Duty Request

Teamsters Local 727 representatives fought to secure about $1,400 in back pay for an MV Transportation Chicago driver.

Earlier this year, paratransit driver Yolanda Davis requested light-duty work and a reduced work schedule. The company wrongfully denied her request, a violation of labor law and the collective bargaining agreement, so the union filed a grievance.

“Management was in clear violation of important laws and clauses that exist to protect members in these cases,” said John Coli Jr., President of Local 727. “This is just another example of the many ways this union fights for our members and their rights.”

Local 727 representatives were prepared to take the case to arbitration, but the company finally agreed to settle the grievance. Per the settlement agreement, MV Transportation owes Davis 108 hours of back pay totaling about $1,400 for the time period she was denied light-duty work. She also shall be reinstated with full seniority rights to her previous position upon her return from the approved leave of absence.

Nothing in this article should be read as the union’s waiver of any legal argument, position or additional grievance. The union does not forfeit its right to make any and all supplemental arguments.
